Terms of Service

These Terms of Service ("Terms") are an agreement between you and [●] Limited, a company registered in Kenya (registration number [●], registered office [●]), which runs HangTing ("HangTing", "we", "us"). They apply to the HangTing app, the website at hangting.app and every service we provide through them. Please read them together with our Privacy Policy, which explains how we handle your personal data.
1. Accepting these Terms
By creating an account or using HangTing you agree to these Terms and confirm you have read the Privacy Policy. If you don't agree, don't use HangTing. When we change these Terms in a way that matters, we'll tell you in the app and ask you to accept the new version before you carry on (see section 20).
2. Who can use HangTing
To use HangTing you must:
- be at least 18 years old, or the age of majority where you live if that is higher;
- be able to enter into a binding contract;
- not be located in a country subject to comprehensive sanctions, or be on a government sanctions list;
- not have been convicted of a sexual offence or any offence involving violence, and not be subject to a court order restraining you from contacting another person;
- not have had a HangTing account removed by us; and
- have only one account.
We may ask you to confirm your age, and we act on reports that an account belongs to someone under 18. Accounts belonging to minors are suspended and deleted.
3. Your account
You're responsible for what happens on your account. Keep your password private, turn on two-factor authentication if you can (Profile → Security), and tell us straight away at [email protected] if you think someone else has access. Give us accurate information — especially your date of birth — and keep it up to date.
4. How HangTing works
HangTing is a plans-first way to meet people. Users post plans (dates or hangouts), and other users apply to join. The host decides who to accept. The exact venue is shared only with people the host has accepted. You can bring a friend as a "+1" on a double date — they must accept the invite before they are added to the plan.
5. Credits
Credits are how HangTing rewards people who show up and discourages people who don't.
- What credits are. Credits are a limited, personal, non-transferable licence to use certain features of HangTing. They are not money, have no cash value, can't be exchanged for money or anything else outside HangTing, and can't be transferred to another person.
- How you get them. You receive starter credits when you join and earn credits by completing plans. You can also buy credit packs in the app. The price is always shown before you pay.
- How they're used. Applying to a plan stakes 3 credits. Your stake is returned if you're not accepted, if the host cancels, or if you withdraw in time.
- Rewards and penalties. Completing a plan with mutual QR verification earns +3 credits (plus up to +2 for a great rating). A host who cancels within 24 hours of the start, after accepting someone, loses 5 credits. Leaving a plan you were accepted onto is free with more than 24 hours' notice; with less, it costs 5 credits and shows a "bailed recently" badge on your profile for 30 days. A confirmed no-show costs 10 credits and adds a visible flake mark. If nobody confirms what happened on a plan that wasn't QR-verified, every participant loses their stake and receives a flake mark. The current rules are always shown in the app and on our FAQ page.
- Purchased credits count the same. Credits you've bought are used and can be lost under the same rules as credits you've earned. We don't refund credits that were lost through the rules above.
- Balances. Credits don't expire while your account is open. When you delete your account, any credits left are cancelled. If we close your account for a reason that isn't your breach of these Terms, we'll refund the purchase price of any bought credits you haven't used.
- Changes. We may change how credits are earned or used for the future, but we won't take away credits you already hold because of a rule change.
6. Paid features
HangTing Plus is a paid subscription with extra features, described in the app. Boosts raise a plan's visibility for a set time. Credit packs add credits to your balance. Event tickets give entry to events run by us or by approved organisers.
- Prices. The price, currency and any taxes are shown before you pay. In the App Store and Google Play, prices are set in your local currency by Apple or Google. For direct payments, prices are in Kenyan Shillings (KES); if you pay with PayPal, the price is converted to US dollars at a live exchange rate plus a small margin, and the dollar amount is shown before you confirm.
- How you pay. In the iOS and Android apps, HangTing Plus, Boosts and credits are bought through Apple or Google, whose terms apply to the purchase. Event tickets, and purchases made outside the app stores, are handled by M-Pesa (Safaricom), Paystack or PayPal. Their own terms apply to the payment itself. We never see or store your card number or M-Pesa PIN.
- Renewal. HangTing Plus bought through Paystack, PayPal or an app store renews automatically at the end of each period until you cancel. Plus bought with M-Pesa is a one-off pass for the period shown and does not renew.
- Cancelling. You can cancel renewal at any time in Profile → HangTing Plus, or through your app store account if you bought it there. Plus stays active until the end of the period you've paid for. Deleting your account cancels renewal automatically.
- Refunds. If a payment fails, is taken twice, or you're charged for something you didn't receive, we'll refund it. Otherwise payments for Plus and Boosts that have started are not refundable, except where the law requires it. App store purchases are refunded by Apple or Google under their policies.
7. Events
Some events are run by us and some by organisers we've approved. The organiser is responsible for the event itself — the venue, the programme, and whether it goes ahead. If an event is cancelled, paid tickets are refunded. Event-specific rules (entry, age limits, refunds for changes) are shown on the event page. You must follow the venue's rules and the law.
8. QR-verified meetups and attendance
A meetup is "verified" only when the participants scan each other's time-limited QR codes in the app. Where this includes a location check, we compare your device's location with the venue at that moment. If a meetup isn't verified, the app asks participants what happened and applies the credit rules in section 5. You agree to use verification and attendance reports honestly: don't share, copy or fake QR codes, spoof your location, or make false reports. If you think an outcome is wrong, contact support — a person will review it.
9. Photo verification
You can choose to verify your profile photos by taking a selfie. The selfie is compared with your profile photos using automated face matching, then deleted. A "Photo verified" badge means the selfie matched your photos. It does not confirm your identity, age, or background, and you shouldn't treat it as doing so for anyone else. Photo verification is optional and needs your explicit consent; see the Privacy Policy.
10. Chat and content
Each plan has a chat for its participants. It closes to new messages 7 days after the plan's start time, and the messages, photos and voice notes are then deleted automatically — unless there is a safety report on that plan, in which case we keep them until the report is resolved.
Your content. You own what you post. You give us a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce and adapt it (for example, resizing a photo) only as needed to run, improve and promote HangTing. This licence ends when your content is deleted, except for copies we must keep for safety, legal or backup reasons for the periods in our Privacy Policy.
Your responsibility. You're responsible for what you post and send. You confirm you have the right to share it, and that it doesn't break the law or these Terms.
11. Community rules
You must not:
- harass, threaten, bully, stalk, intimidate or endanger anyone;
- post or send sexual content involving anyone under 18, or any content that sexualises minors (see section 12);
- post nudity or sexually explicit material, or send it to someone who hasn't asked for it;
- post hate speech, or content that promotes violence, terrorism or self-harm;
- impersonate anyone, or misrepresent your age, identity or intentions;
- use HangTing to sell anything, recruit, solicit money, advertise, or offer or seek sexual services;
- post fake, duplicate or misleading plans or events;
- scam or defraud anyone, or ask other users for money;
- collect other users' data, scrape the service, or use bots or automation;
- try to get around the credit system, verification, attendance reporting, blocks or suspensions;
- interfere with the security or operation of HangTing, probe it for vulnerabilities without our permission, or reverse-engineer it except as the law allows; or
- break the law.
If you find a security vulnerability, please report it to [email protected] and give us a reasonable chance to fix it before telling anyone else. We won't take action against good-faith research that follows this rule.
12. Child safety
HangTing has zero tolerance for child sexual abuse and exploitation. We remove such content, preserve the evidence, permanently ban the accounts involved, and report it to the authorities as the law requires — including the police where the user is located, the Directorate of Criminal Investigations in Kenya, and the National Center for Missing & Exploited Children (NCMEC) in the United States. 13. Blocking, reporting and moderation
You can block anyone at any time — it's immediate and private. You can report a person or a plan in the app, or email [email protected]. Reports are reviewed by people. We may remove content, apply credit penalties, restrict features, or suspend or remove accounts, and we may act on a pattern across several reports. Where we can do so safely, we'll tell you what we did and why, and you can ask us to review a decision by emailing [email protected].
14. Safety
HangTing helps people arrange to meet in person. We don't run criminal background checks on users, and we can't guarantee anyone's identity, intentions or behaviour. Safety tools such as SOS, shake-to-alert, trusted contacts, approximate locations and reporting reduce risk but can't remove it. Meet in public places, tell someone where you're going, and leave if you feel unsafe — see our Safety page. In an emergency, call your local emergency number (999 or 112 in Kenya, 112 across the EU, 911 in the US).
15. Other services
HangTing links to or relies on other services — maps, payment providers, app stores. Their terms apply to your use of them and we're not responsible for them.
16. Our intellectual property
HangTing's name, logo, design and software belong to us or our licensors. We give you a personal, non-transferable, revocable licence to use the app for its intended purpose. Don't copy, modify or distribute it except as the law allows.
17. Disclaimers
We work hard to keep HangTing running and accurate, but we provide it "as is" and "as available". To the extent the law allows, we don't promise that it will always be available, error-free, or that you'll meet anyone through it. Nothing in these Terms affects rights you have under the Consumer Protection Act, 2012 or any other law that can't be excluded by contract.
18. Our liability
- We're responsible for loss you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care.
- We're not responsible for loss caused by other users' behaviour, on or off HangTing, except where it results from our own failure to act with reasonable care.
- We're not liable for loss of profit, business or opportunity, or for indirect loss that wasn't foreseeable.
- Otherwise, our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or KES 10,000.
- Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit.
19. If you break these Terms
You're responsible for loss we suffer because you broke these Terms or the law — for example, costs from a claim by another user arising from your conduct.
20. Changes to these Terms
We may update these Terms as HangTing changes. For changes that matter, we'll tell you in the app at least 14 days before they take effect (unless a change is needed sooner for legal or safety reasons) and ask you to accept them. If you don't accept, you can delete your account; any unused period of HangTing Plus you've paid for will be refunded pro rata if the change affects it.
21. Ending your account
You can delete your account at any time in Profile → Security → Delete account. We may suspend or close your account if you break these Terms, if we must for legal reasons, or if your account puts others at risk. Where it's safe to, we'll tell you why. If we close your account without you having broken these Terms, we'll refund the unused part of any Plus subscription and any unused purchased credits. Sections 5 (balances), 10 (licence), 17–19, 22 and 23 continue after your account ends.
22. Disputes and governing law
These Terms are governed by the laws of Kenya, subject to section 23 if you live elsewhere. If you have a complaint, please contact us first at [email protected] — most problems are solved that way. If we can't resolve a dispute within 30 days, either of us may refer it to arbitration in Nairobi under the Arbitration Act, 1995, before a single arbitrator agreed by both of us or, failing agreement, appointed by the Chartered Institute of Arbitrators (Kenya Branch). The arbitration will be in English. This doesn't stop you from bringing a claim in the Small Claims Court, or from complaining to the Competition Authority of Kenya or the Office of the Data Protection Commissioner.
23. If you live outside Kenya
HangTing is available worldwide. Where you live may give you rights that these Terms can't take away, and nothing in these Terms limits them. In particular:
- European Union, EEA and United Kingdom. You keep the protection of the mandatory consumer laws of the country where you live, and you may bring a claim in the courts there instead of arbitration. If you buy a subscription or credits directly from us, you have 14 days to withdraw; if you ask us to start the service straight away, you agree to pay for what you used before withdrawing, and you lose the right to withdraw from credits once you've used them. Purchases made through Apple or Google follow their refund rules.
- Digital Services Act (EU). Our single point of contact for users and authorities is [email protected] (English). You can report content you believe is illegal in the app or to that address, including why you think it is illegal. We'll act on it promptly, tell you what we decided, and explain any decision to remove your content or restrict your account. You can challenge our decisions through our internal complaints process (reply to the decision or email [email protected]) and, in the EU, through a certified out-of-court dispute settlement body. Our legal representative in the EU is [●].
- United Kingdom — Online Safety Act. We assess and reduce the risk of illegal content and activity on HangTing — including fraud, harassment, intimate image abuse and grooming — act swiftly on reports, and give you a way to complain about our decisions ([email protected]). You can also complain to Ofcom.
- United States. Nothing in these Terms limits rights you have under the law of your state. If the arbitration clause in section 22 can't be enforced against you, you may bring your claim in your local small-claims court.
- Australia and New Zealand. Our services come with guarantees that can't be excluded under the Australian Consumer Law and the New Zealand Consumer Guarantees Act; section 18 doesn't limit them.
- Elsewhere. Where local law gives you more protection than these Terms, local law applies to that extent.
If these Terms are translated, the English version governs, unless your local law says otherwise.
24. General
If any part of these Terms can't be enforced, the rest still applies. If we don't enforce a right straight away, we can still enforce it later. You can't transfer your rights under these Terms; we may transfer ours to a company that takes over HangTing, and we'll tell you if that happens. These Terms, the Privacy Policy and any feature-specific terms shown in the app are the whole agreement between us about HangTing.
